Buying property in Hesse adds 6% property transfer tax to the purchase price. On a €500,000 property, that is €30,000 before notary, land register and possible estate-agent costs.

How to calculate the tax

The initial calculation is straightforward: purchase price × 6% = property transfer tax.

The tax is part of the ancillary purchase costs. It does not increase the property's collateral value, so financing it usually raises the loan-to-value ratio.

What forms the tax base

For a conventional purchase, the agreed price is generally the tax base. Under the German Property Transfer Tax Act, assumed obligations and certain retained rights can also form part of the consideration. The economic agreement as a whole matters.

Movable items sold with the property, such as a fitted kitchen or free-standing furniture, may sit outside the tax base if they are individually listed in the contract at realistic current values. An unsupported or inflated allocation may be challenged by the tax office.

Land purchase combined with a building contract

If the land purchase and construction agreement are economically connected, the tax may apply not only to the land price but also to the building costs. German tax law refers to this as a uniform contractual arrangement. This issue should be reviewed before signing, especially for developer projects or coordinated land-and-build packages.

Exemptions

Common exemptions include transfers between spouses or registered civil partners, transfers between direct-line relatives such as parents and children, and certain acquisitions connected with an estate. Siblings are not automatically exempt merely because they are related. Gifts, inheritances and mixed transfers need individual tax and legal advice.

From notarisation to the land register

  1. The notary reports the notarised transaction to the tax authority.
  2. The central property transfer tax office in Hesse issues the tax assessment.
  3. Payment is generally due one month after the notice is served.
  4. After full payment, the clearance certificate is sent to the notary.
  5. The transfer of ownership can then be completed in the land register.

The money must therefore be available early. Buyers should not assume that a later mortgage disbursement will automatically cover the deadline.

Hessengeld: a grant, not an exemption

Hessengeld supports qualifying first-time buyers of an owner-occupied home or building plot in Hesse where the notarised purchase took place on or after 1 March 2024. The programme provides up to €10,000 per eligible buyer and up to €5,000 per eligible child, capped at the property transfer tax actually paid.

The tax must still be paid in full. Once approved and the move-in has been evidenced, Hessengeld is paid in ten equal annual instalments. It therefore does not replace the cash required on the tax due date.

Applications are made through the WIBank customer portal. If the buyer has not moved in when applying, proof of residence generally has to be submitted within three years. Prior property ownership may exclude eligibility. Always check the latest rules on the official State of Hesse website.

What is the property transfer tax rate in Hesse in 2026?
The rate in Hesse is 6% of the taxable consideration. For a standard purchase, this is generally the agreed purchase price. A property costing €400,000 therefore triggers €24,000 in property transfer tax.
When does the tax have to be paid?
Payment is generally due one month after the tax assessment notice has been served. Once it has been paid in full, the tax office issues the clearance certificate required for registration of the new owner in the land register.
Can the tax be included in the mortgage?
It can be included if the borrower's credit profile and the lender's criteria allow it. Since the tax does not add value to the property securing the loan, financing it increases the loan-to-value ratio and may result in a higher interest rate.
Does the tax apply to a fitted kitchen?
Movable items such as a fitted kitchen may fall outside the tax base if they are listed separately in the purchase agreement at plausible current values. The tax office may review and correct an artificial allocation.
Who may qualify for Hessengeld?
The programme is aimed at people buying a residential property or building plot in Hesse for the first time, from 1 March 2024 onwards, and using the future home themselves. Prior ownership, including a share in a property, may exclude an applicant.
Is Hessengeld a tax exemption?
No. Buyers must pay the tax in full first. Hessengeld is a separate state grant, capped at the tax actually paid and disbursed in ten equal annual instalments if all eligibility requirements are met.
