Financing confirmation: what it is worth with an estate agent and what it does not do.
It opens the door to the viewing. It does not give you a claim to the loan.

German estate agents ask for it before they let you view at all. What the letter says decides how far it carries.
A Finanzierungsbestätigung is a letter from your bank or mortgage broker stating a financing range that is realistic after a first review of your figures. It is proof of eligibility towards the seller and the estate agent, not a contract: the claim that money will actually flow only arises with the loan agreement (Section 488 (1) BGB), and that agreement has to be concluded in writing (Section 492 (1) BGB). In between sits the Finanzierungszusage, the commitment, which is only issued after a full assessment and a valuation of the specific property. For the confirmation, proof of income and equity is enough; it is usually ready within one to three working days and is customarily valid for three to six months. Property documents are only needed for the stage after that.
What a financing confirmation actually says
A financing confirmation is short, usually a single page. It names you as the borrower, a financing or purchase price range, the issuer and a date up to which the statement is meant to hold. Almost always it carries a caveat tying the statement to a full review of the documents and to the valuation of the property. What it typically does not contain matters just as much: no salary figures, no employer or account details, no credit score. That is precisely where its practical value lies. It answers the one question the seller is entitled to ask without disclosing your income.
It is issued either by the bank handling your enquiry or by your mortgage broker. In practice a broker's confirmation is no weaker, as long as it makes clear what it rests on: which documents were reviewed and which assumptions on interest and repayment were used. What is weak is a letter that merely asserts without naming a basis. So when you request one, ask for wording that names the documents reviewed rather than wording that sounds as binding as possible.
A second point is regularly overlooked. The confirmation is almost always based on a conditions enquiry rather than a credit application. For your SCHUFA record that is the decisive difference, because only the credit application leaves a marker visible to other banks. How these two enquiry types work, and why several real applications in a row actively worsen your position, is explained in our guide when financing is declined.
Confirmation, commitment, loan agreement: the three stages
In the German market „Finanzierungsbestätigung“ and „Finanzierungszusage“ are often used interchangeably, including by estate agents. Behind them sit three clearly distinct stages, each with a different binding effect. Which one you are holding is not revealed by the heading but by two questions: has the bank valued this specific property, and does it commit itself to a statement?
| Stage | Basis | Effect |
|---|---|---|
| Financing confirmation | your figures and first documents | names a range, no property, no commitment |
| Commitment and loan offer | complete documents and property valuation | property-specific, bank is bound by its offer |
| Loan agreement | signed in writing by both sides | claim to payout, withdrawal period running |
Only the third stage makes money flow. It is the loan agreement that obliges the lender to make a sum of money available to the borrower in the agreed amount (Section 488 (1) BGB). And that agreement needs a form: consumer loan agreements are to be concluded in writing unless a stricter form is prescribed (Section 492 (1) BGB). A confirmation sent as a PDF is therefore never the contract, however confirmatory its wording. Where this sits in the purchase process is set out in our guide to buying a house in Germany.
Why no bank commits bindingly at the first step
The most common disappointment at this point: the estate agent demands a „binding“ confirmation and the bank will not issue one. That is neither obstruction nor a matter for negotiation, it follows from the duty to assess. For residential mortgage loans the bank must examine creditworthiness thoroughly, on the basis of necessary, sufficient and appropriate information on income, expenses and other financial and economic circumstances. Above all, it may not base that assessment mainly on the value of the residential property exceeding the loan amount (Section 505b (2) BGB). As long as the property is not fixed and the documents are incomplete, the bank simply lacks the basis to commit.
There is a practical way to handle the agent's demand. Do not ask your bank for a word it cannot stand behind, ask for a letter that names the basis it reviewed. One sentence on which income documents were available and as at which date convinces an experienced agent more than the word „binding“ without substance. The reverse also holds: a provider promising you a firm commitment before any document review is a warning sign, not a service.
The property valuation is the step most often underestimated. The bank does not calculate with the purchase price but with its own mortgage lending value, and from that follows the loan-to-value ratio, which in turn drives the interest rate. This is exactly where financings break that looked settled on paper.
How fast the confirmation arrives and what the bank needs for it
For the confirmation the bank needs your figures, not the property's. As a rule that means identification, income statements for the past months, proof of available equity and an overview of current obligations. Self-employed applicants replace the payslips with annual accounts or income surplus statements and the current business evaluation. Once that is complete, the confirmation is usually ready in one to three working days. The full list sorted by case, including a checklist to print, is in our guide to the documents for a German mortgage.
The observation from our brokerage practice: the bottleneck is almost never the bank's processing time but the gathering of the evidence. Anyone who starts looking for documents once the property is found loses exactly the days in which the sale is awarded. That is why the confirmation belongs before the first viewing, not at the end of it. Which instalment your figures can actually carry, and how that converts into a loan amount, is set out in how much house you can afford.
What the estate agent may ask for and what you need not hand over
It is legitimate for an estate agent to want to know, before a viewing, whether a prospective buyer can pay for the property. The financing confirmation is made for exactly that: it answers the question without disclosing your income data. In practice, however, requests often go further and ask for payslips, bank statements or a SCHUFA report at the very first contact.
The benchmark here is the principle of data minimisation: personal data must be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (Article 5 (1) (c) GDPR). For shortlisting prospective buyers, proof of financeability is the milder and sufficient route; the full credit assessment is a matter for the bank granting the loan, which is legally obliged to carry it out. A workable sentence on the phone is therefore: my bank's confirmation is available, the income documents go to the bank.
Two points from practice. First, hand over a confirmation only for the amount you need for this property, not for your maximum range. Disclosing your ceiling means negotiating the price against yourself. If in doubt, have the confirmation issued for the specific property. Second, a reservation agreement does not replace financing and only binds the agent; the Federal Court of Justice held standard-form reservation fees to be invalid in its judgment of 20 April 2023 (I ZR 113/22). The context is in our guide to buying a house in Germany.
The confirmed range is not your purchase price budget
The costliest misreading of a financing confirmation is also the simplest: the stated sum is taken for the price you can bid. But it is the loan amount. Ahead of it sit the purchase costs, in Hesse around seven and a half to eight per cent of the purchase price without and eleven to twelve per cent with an estate agent. They fall due almost entirely before the loan is paid out and have no counterpart in the mortgage lending value, so they come out of equity.
The second gap opens when the bank values the property below the agreed purchase price. Because the loan amount follows the mortgage lending value rather than the price, every deviation feeds straight into the equity required. The table below shows how much equity the purchase price alone then demands, depending on the valuation and the loan-to-value ratio the bank allows. All figures as a percentage of the purchase price, purchase costs on top:
| Bank valuation | Equity at 90 % loan-to-value | at 80 % loan-to-value |
|---|---|---|
| Valuation matches the purchase price | around 10 % | around 20 % |
| Valuation is 5 % below | around 14.5 % | around 24 % |
| Valuation is 10 % below | around 19 % | around 28 % |
| Valuation is 15 % below | around 23.5 % | around 32 % |
Own calculation by ME Finance, rounded. Assumption: loan equals loan-to-value ratio times valuation, equity equals purchase price minus loan. Purchase costs not included.
Read the rows from top to bottom and the mechanism becomes visible: if the valuation comes in ten per cent below the purchase price, the equity needed at a 90 per cent loan-to-value ratio rises from around ten to around nineteen per cent of the price. The gap is therefore almost twice the size of the deviation itself. That is why a confirmation over a generous range does not rescue a financing where the price paid is above the valuation. With our standard assumptions of 3.5 per cent borrowing rate and 2 per cent initial repayment, the annual instalment is 5.5 per cent of the loan amount, so a larger loan also has to be carried by the household budget calculation, not only by the land register.
When the confirmation expires or the agent wants more
A financing confirmation is customarily valid for three to six months, and the deadline is stated in the letter. What matters, though, is not the date but the basis: it rests on your figures and on the interest level of the day it was issued. A new instalment loan, an employer change within a probation period or a markedly higher interest level devalue the stated range even while the deadline is still running. So have the confirmation refreshed before a serious offer rather than extended.
Once matters become concrete, you have more rights than most buyers use. You may request a draft of the consumer loan agreement from the lender; for residential mortgage loans the lender must offer you a draft as soon as it submits an offer or a binding proposal (Section 491a (2) BGB). That draft, not the confirmation, is the document you can genuinely compare and negotiate with. Alongside it sits the lender's duty to explain the main features and effects of the agreement adequately before it is concluded (Section 491a (3) BGB).
After signature a safety net remains: a borrower under a consumer loan agreement has a right of withdrawal (Section 495 (1) BGB). In the few cases where it exceptionally does not apply, for instance where the loan agreement is notarised, residential mortgage borrowers must instead be given a reflection period of at least seven days, during which the bank is bound by its offer (Section 495 (2) and (3) BGB). The resulting order is unambiguous: first the commitment and the draft agreement, then the notary appointment. A purchase contract obliges you to pay the price regardless of whether your loan is in place.
What to take away from this guide
- The financing confirmation is proof of eligibility for sellers and agents, not a claim to payout. That arises only with the written loan agreement (Sections 488 (1), 492 (1) BGB).
- Three stages: confirmation without a property, commitment after valuation and full assessment, then the contract. What counts is not the heading but whether the property has been valued.
- No bank commits before valuing the property, because it must assess creditworthiness thoroughly and may not rely mainly on the property's value (Section 505b (2) BGB).
- Towards the agent the confirmation is enough. Payslips and credit bureau reports belong with the bank; the benchmark is data minimisation (Article 5 (1) (c) GDPR). Never disclose your maximum range.
- The confirmed amount is the loan, not the purchase price budget. If the bank's valuation is ten per cent below the price, the equity needed at 90 per cent loan-to-value rises from around ten to around nineteen per cent of the price, plus purchase costs.
- Refresh before bidding rather than extend, and request the draft agreement once a concrete offer is on the table (Section 491a (2) BGB).
ME Finance is not a credit institution. We compare offers from more than 500 banks and credit institutions and issue the financing confirmation as soon as your documents have been reviewed, so that you are not the prospective buyer without proof at the viewing. Frequently asked questions about the financing confirmation
- What is a Finanzierungsbestätigung?
- A Finanzierungsbestätigung, or financing confirmation, is a letter from your bank or mortgage broker stating a financing range that looks realistic after a first review of your income and assets. It serves as evidence to the seller and the estate agent that you are a serious buyer. It usually contains your name, the range and a validity note, but no salary figures and no bank statements. Legally it is not a loan agreement: the claim to payout only arises with the contract itself (Section 488 (1) of the German Civil Code, BGB).
- Is a financing confirmation binding?
- As a rule it is not, and the letter usually says so. A confirmation is issued before the property is valued and often without complete documentation. Financing becomes binding only with the written loan agreement; consumer loan agreements must be concluded in writing (Section 492 (1) BGB). Between the two sits the bank's concrete loan offer, to which it is bound for a stated period. Always read the wording: „after an initial review“ is not the same as „we hereby confirm bindingly“.
- What is the difference between a Finanzierungsbestätigung and a Finanzierungszusage?
- The terms are used inconsistently in the market, but they describe two different stages. The Finanzierungsbestätigung comes early, rests on your own figures and first documents and names a range without a specific property. The Finanzierungszusage comes once the bank has completed the full creditworthiness assessment and valued the property; it refers to that one property and leads into the loan agreement. What matters is not the heading of the letter but whether a property valuation has taken place and whether the bank commits itself.
- How long does a financing confirmation take?
- With complete documents, a confirmation usually takes one to three working days, and in simple cases the same day. The bottleneck is almost never the bank but assembling the evidence: income documents, proof of equity, identification and, for the self-employed, annual accounts. A binding commitment takes longer because the bank also values the property and completes the full creditworthiness assessment; one to two weeks is a realistic range for that.
- Which documents does the bank need for a financing confirmation?
- For the first step, identification, recent income statements, proof of available equity and an overview of existing obligations are usually enough. Self-employed applicants provide annual accounts or income surplus statements and the current business evaluation instead. Property documents are not yet needed for the confirmation, but they are mandatory for the commitment, because the bank has to value the property. Our guide to the documents for a German mortgage lists everything sorted by case.
- How long is a financing confirmation valid?
- Three to six months is customary, and the deadline is stated in the letter itself. It is not a formality: the confirmation rests on a snapshot of your figures and on the interest level of the day it was issued. If your income, existing loans or the interest level change noticeably, the stated range no longer holds, even if the deadline is still running. Have the confirmation refreshed before any serious offer rather than waiting for the estate agent to object.
